Welcome to Arts by Dylan (ABD). By browsing our shop or making a purchase, you acknowledge that you agree to the following terms and conditions. Our goal is to strike a balance between protecting the creative integrity of the artist and upholding your rights as a collector.

1. The Artistic Process (Photography & Synthesis)

At Arts by Dylan, we take pride in our artistic process, which involves:

  • Original Capture: Each piece begins with original photography captured by Dylan.
  • Atmospheric Synthesis: Our unique processing techniques refine and enhance the images to create distinctive works of art.
  • Intellectual Property & Protected Assets: All artwork created by Dylan is protected by copyright law.
Theme & Style Palettes: Many of the color schemes and palettes used in the 30 ABD theme styles originate from actual photographs taken by Dylan Carpowich or other art created by the artist. These palettes were extracted and refined with AI-assisted tools and used to generate or edit the theme’s CSS, so the same artistic vision extends to the look and feel of the shop itself.
  • Final Product: The resulting art is an original creative expression that transcends raw photography, representing a unique artistic vision.

2. Intellectual Property & "Vibe Coded" Assets

The distinctive aesthetic, digital logic, and overall "vibe" of Arts by Dylan are safeguarded as proprietary assets. This includes:

  • Copyright Protection: All images, designs, and text created by Arts by Dylan are the exclusive property of our brand. We strictly prohibit unauthorized reproduction, resale, or commercial use of our works.
  • Vibe Coding & Unique Artistic Style: Our "Vibe Coded Assets" refer to a distinct artistic style developed through carefully crafted digital parameters. While certain styles may be similar, the unique synthesis of our visuals is protected under copyright law.
  • Personal Use: Purchases grant you a license for personal display only. You may not use ABD art for commercial branding, advertising, or as training data for AI models without prior written consent.

3. Software & Logic (MIT License)

Parts of our digital experience, specifically the code used for theme animations or "vibe scripts" that may be shared for community use, are governed by the MIT License:

4. E-commerce & Liability

  • Platform: ABD is hosted on Shopify. While we secure our theme-level logic, Shopify handles the secure server-side processing of your transactions.
  • Accuracy: We strive for color accuracy, but please note that "vibe-coded" atmospheres may vary slightly depending on your screen settings and the physical print medium.
  • Limitation of Liability: Arts by Dylan is not liable for any indirect or consequential damages arising from the use of our site or the purchase of our products beyond the total purchase price.

5. Dispute Resolution
